You may be eligible for an Affidavit for Transfer of Title to Real Property if the following requirements are met:

(Real property means real estate such as houses, land, commercial real estate, etc.  Mobile homes are usually considered personal property, unless certain requirements are met.)

 
  1. At least 6 months have passed since the death of the decedent.
  2. The real property is located in Arizona, and its assessed value, less liens and encumbrances, does not exceed $100,000.  The value of the real property is determined using the assessor’s full cash value for the year the decedent passed away.
  3. A personal representative has NOT been appointed for the estate.
  4. Funeral expenses, taxes, expenses of last illness, and all unsecured debts of the decedent have been paid.
  5. You are entitled to claim the decedent’s property.
